New Jersey S1812 establishes new requirements for determining whether a student has a specific learning disability under the federal Individuals with Disabilities Education Act. The bill allows the use of a process based on the child’s response to scientific, research-based intervention and permits other alternative research-based procedures. Effective July 1, 2023, it prohibits the use of a severe discrepancy between intellectual ability and achievement for determining a specific learning disability.
