New Jersey S1550 creates the new offense of theft by financial exploitation of a vulnerable person. This offense occurs when someone in a position of trust, such as a family member or caregiver, commits a theft offense against a senior citizen or a person with a disability. The bill defines a senior citizen as someone 62 years of age or older and a person with a disability as someone substantially incapable of exercising normal physical or mental power of resistance due to a pre-existing medically determinable physical or mental impairment.
