S.1306

Prohibits consumer reporting agencies from making reports containing adverse information related to employees affected by federal government shutdown.

Introduced·1/9/24

New Jersey S1306 prohibits consumer reporting agencies from including adverse information related to federal government shutdowns in consumer reports.

New Jersey S1306 amends the "New Jersey Fair Credit Reporting Act" to ensure that consumer reporting agencies do not include adverse information in consumer reports that stems from federal government shutdowns beginning on or after December 22, 2018. Affected employees, defined as federal employees or contractors whose pay was suspended during a shutdown, can request that such information be disregarded. The bill also mandates that any consumer reporting agency or user of a consumer report must respond to such requests within five days. The act is retroactive to December 22, 2018.
