New Jersey S1209 authorizes the Director of the Division of Alcoholic Beverage Control to temporarily waive the requirement that farm wineries use at least 51% New Jersey grown fruit during the first five years of operation. The waiver can be granted if the winery agrees to use the minimum percentage of New Jersey grown fruit as soon as practicable and does not exceed its highest production year using out-of-state fruit. The director may charge a fee for the waiver application and must decide within 15 days. The waiver aims to provide flexibility to new farm wineries.
