New Jersey A965 revises and updates guardianship laws to encourage ethical conduct by guardians and provide stronger protections for wards and proposed wards. The bill mandates that a ward or proposed ward must be represented by counsel throughout guardianship proceedings. It requires counsel to personally interview the ward or proposed ward and, if the ward is not represented and unable to afford counsel, for the court to appoint counsel. The bill also requires counsel to file a report with the court before the hearing date.
