This bill amends existing law to require defendants charged with crimes with bail restrictions or vehicular homicide to be placed under pretrial home supervision if not incarcerated prior to trial. The court may order this detention if the prosecutor seeks it and the court finds clear and convincing evidence that no amount of monetary bail or non-monetary conditions would reasonably assure the defendant's appearance in court or the safety of others. The court may also order detention if the defendant fails to rebut a presumption of detention for certain crimes.
