New Jersey A5110 prohibits sellers from charging a surcharge to customers using debit cards for services or goods.

New Jersey A5110 amends existing law to prohibit sellers from imposing a surcharge on customers who use debit cards for services or goods. The bill also mandates that sellers clearly disclose any surcharges on credit card transactions. A violation of these provisions is considered an unlawful practice under the consumer fraud act, with penalties including monetary fines, cease and desist orders, punitive damages, treble damages, and costs awarded to the injured party. The act takes effect immediately.
