New Jersey A5052 allows construction companies, contractors, or subcontractors to sue other companies, contractors, or subcontractors for wage or benefit theft, misclassification of employees, tax or insurance fraud, manipulation of bid processes, falsification of documentation, and actions violating the New Jersey Antitrust Act or consumer fraud act. The plaintiff must notify the defendant 30 days before filing the action and the Department of Labor and Workforce Development. The court can award reasonable attorneys’ fees and costs, including expert witness fees, to the prevailing party.
