Prohibits use of prevailing wage fringe benefit portion to fund certain bonus programs.
The bill prohibits employers from using the fringe benefit portion of the prevailing wage rate to fund bonus, incentive, productivity, retention, or similar compensation programs. Employers cannot require or automatically enroll employees in wage-specific pension, annuity, or retirement programs for this purpose without prior written consent. Employees declining to participate will receive the fringe benefit portion through other means permitted under the "New Jersey Prevailing Wage Act." The bill does not apply to employees of employers signatory to a collective bargaining agreement used to.
