New Jersey A493 allows municipalities to place a lien on the insurance proceeds of fire-damaged properties under certain conditions. Municipalities must adopt an ordinance to place these liens, which can be up to the amount of coverage available for damages caused by fire or explosion. The lien expires if the municipality determines the fire resulted in a total loss or fails to provide notice within 90 days of the fire or 45 days of receiving notice from the insurer or insured.
