New Jersey A4869 creates new criminal offenses for possessing or using credit card scanners without lawful purpose. Possessing a credit card scanner without a lawful purpose is a disorderly persons offense, punishable by a fine of up to $1,000, imprisonment for up to six months, or both. Using a credit card scanner for an unlawful purpose is a crime of the second degree, punishable by a fine of up to $150,000, imprisonment for between five and 10 years, or both.
