Introduced Text

New Jersey A4859 exempts biomass, solar, and wind energy projects on farmland preservation areas from State Agriculture Development Committee.

New Jersey A4859 amends existing law to clarify that prior approval from the State Agriculture Development Committee is not required for constructing, installing, or operating biomass, solar, or wind energy facilities on farmland preservation exception areas. The bill specifies that such energy projects can proceed without committee approval, provided they meet certain conditions, including not interfering with agricultural production and being limited in capacity or area. The bill also maintains the requirement for Department of Agriculture approval for biomass facilities on preserved farms.
