New Jersey A4638 prohibits employment of unauthorized aliens and mandates use of E-Verify program for all employers.

New Jersey A4638 mandates that all employers verify the employment eligibility of new hires through the E-Verify program. Employers with 100 or more employees must comply by December 31, 2020, while those with fewer than 100 employees must comply by December 31, 2021. The bill prohibits the employment of unauthorized aliens and imposes penalties for violations. For a first violation, the court may order the termination of unauthorized aliens, a probationary period, license suspension, and a sworn affidavit. A second violation results in permanent license revocation.
