This bill upgrades the degree of crime for auto theft when it occurs in connection with a home invasion or residential burglary. Auto theft becomes a second-degree crime if it happens during a residential burglary and a first-degree crime if it happens during a home invasion burglary. The value of the stolen vehicle and any associated tax evasion are considered in determining the crime's degree. A conviction for auto theft will not merge with a conviction for home invasion or residential burglary. The bill amends existing law to reflect these changes.
