New Jersey A3630 authorizes the Department of Environmental Protection to enter into settlement agreements with violators of environmental laws. These agreements can include the performance of supplemental environmental projects (SEP) to replace a portion of the monetary penalties for the violations. The SEP can offset up to 75% of the penalty, or up to 50% for violations of the Water Pollution Control Act. The violator proposes the SEP, which must be approved by the department.
