New Jersey A3486 excludes environmentally sensitive and flood-prone land from being designated as vacant for affordable housing construction.

New Jersey A3486 amends the Fair Housing Act to exclude certain environmentally sensitive and flood-prone land from being designated as vacant or available for affordable housing construction. This includes land regulated by state or federal agencies, such as the Highlands Water Protection and Planning Council, and land subject to the Flood Hazard Area Control Act or Freshwater Wetlands Protection Act. The bill also makes technical amendments to replace references to the inactive Council on Affordable Housing. This change takes effect immediately upon enactment.
