Introduced Text

New Jersey A3041 mandates automatic machine and hand recounts for certain elections resulting in tie votes and outlines a process for resolving.

New Jersey A3041 requires an automatic machine recount for elections, excluding primary and school elections, that result in a tie between two or more candidates. If the machine recount also results in a tie, an automatic hand recount must follow. If the hand recount still results in a tie, a special election must be held within 60 days of the original election, restricted to the tied candidates. The appropriate board of elections conducts the recounts, with the state reimbursing the costs.
