New Jersey A2977 creates a private right of action for violations of the "Fair Foreclosure Act.

New Jersey A2977 amends the "Fair Foreclosure Act" to allow individuals to sue residential mortgage lenders in Superior Court for violations. Successful plaintiffs can seek actual damages or $1,000, whichever is greater, along with attorney's fees, costs of the suit, and appropriate equitable relief. The act will take effect four months after its enactment.
