New Jersey A2501 allows PERS retirees to return to elective public office without losing retirement benefits under certain conditions.

New Jersey A2501 permits a retired member of the Public Employees’ Retirement System to return to an elective public office with their former employer, either by appointment or election, without canceling their retirement. This applies if the retiree was granted a retirement allowance for reasons other than disability, the return occurs after the retirement allowance becomes due and payable, the retiree had reached the service retirement age at the time of retirement, and the compensation for the elective office is less than $12,000 per year.
