New Jersey A2304 permits outdoor dining on certain property with tents and other fixtures.
New Jersey A2304 allows restaurants, bars, distilleries, and breweries to use outdoor spaces and public sidewalks for dining from April 1 to December 1. Owners and operators must maintain a four-foot-wide walking path on sidewalks, remove fixtures daily if required, and not block more than 75% of parking spaces unless the lot has fewer than eight spaces. Tents and other fixtures must comply with fire safety and construction codes. The bill also allows municipalities to require insurance, consent from property owners, or indemnification agreements.
