Introduced Text

Allows prior participants in certain marijuana offense diversion programs to participate again if the offense was decriminalized.

New Jersey A1952 modifies eligibility for conditional discharge, pretrial intervention, conditional dismissal, and the Veterans' Diversion Program. It allows individuals previously arrested for marijuana offenses that have since been decriminalized to participate in these diversion programs again. Previously, participation in these programs barred future participation. The bill applies retroactively to February 22, 2021, the effective date of the decriminalization laws.
