New Jersey A1804 amends existing law to require courts to provide certain defendants with a referral for a psychological or psychiatric evaluation and an evaluation for drug or alcohol dependency upon ordering their pretrial release. This requirement does not apply if the court orders the defendant to undergo available psychological or psychiatric treatment, including treatment for drug or alcohol dependency, and remain in a specified institution. The provider of the evaluation must notify the court if the defendant completes the evaluation.
