New Jersey A1270 prohibits the Department of Environmental Protection from requiring certain municipalities to adopt ordinances that control tree removal and replacement as part of the Municipal Stormwater Regulation Program. Specifically, it prevents the DEP from mandating such ordinances for municipalities assigned to Tier A under N.J.A.C.7:14A-25.3. This bill responds to a recent change in the NJPDES Tier A Municipal Stormwater General Permit that required these ordinances, effectively nullifying that requirement.
