New Jersey A1261 permits municipalities with populations under 12,000 and no police department to hire candidates outside the civil service eligible list if the Civil Service Commission fails to respond within 30 days or if no appointment results from the list. The municipality must sign a waiver exempting the candidate from the civil service hiring process. The candidate must then complete a working test period to gain civil service status. The Civil Service Commission cannot require the municipality to replace the candidate upon issuing a certified eligible list.
