New Hampshire SB436 revises zoning board of adjustment membership criteria.
New Hampshire SB436 repeals and reenacts RSA 673:3, V to clarify that any member of a zoning board of adjustment with a conflict of interest must recuse themselves from acting or voting on the matter. Conflicts of interest include circumstances where the member's impartiality might reasonably be questioned, such as prior involvement in the matter in a quasi-judicial capacity as a voting member of another board. This act takes effect 60 days after its passage.
