New Hampshire SB435 modifies the criteria for zoning board of adjustment variances. The board can authorize a variance if the proposed use is reasonable and the restriction does not substantially serve public purposes, or if the property cannot be used in strict compliance with the ordinance. The board must use a consistent voting method for all applications and any change in this method will apply only prospectively. The act takes effect 60 days after its passage.
