New Hampshire HB459 modifies zoning laws to limit lot size requirements for single-family homes in areas without municipal sewer infrastructure.

New Hampshire HB459 amends RSA 674 by adding a new section on single-family housing acreage. It stipulates that in areas zoned for single-family residential use without municipal or community sewer infrastructure, lot sizes cannot exceed those required by the Department of Environmental Services for individual sewage systems larger than 22,000 square feet, provided there is sufficient sewage capacity. This restriction does not apply if the municipality can show that larger lot sizes are necessary for community health or safety.
