HB1361

Relative to the procedure concerning search warrant inventories.

Final Passage·6/10/26

Amends search warrant procedures to require inventories of seized property and receipts for items taken.

New Hampshire HB1361 amends search warrant procedures to mandate that law enforcement officers provide a receipt for items seized and a written inventory of all property taken. The inventory must be made in the presence of the applicant for the warrant, the law enforcement officer, the person from whose possession or premises the property was taken, or at least one credible person. If the warrant is for electronically stored, remote, or off-site information and is submitted electronically, the inventory may be made without a witness, provided the officer attests to its accuracy.
