New Hampshire HB1216 amends informed consent requirements for law enforcement searches of homes and vehicles.

New Hampshire HB1216 modifies the conditions under which law enforcement officers can search homes or vehicles without a warrant. It requires officers to inform individuals of their right to refuse consent and mandates documentation of consent. Refusal to consent cannot lead to arrest or detention. Searches without consent are inadmissible in court if the officer violates the law. The act does not affect searches incident to arrest, officer safety searches, or correctional facility searches. The changes take effect January 1, 2027.
