Text Text

Clarifies the equity jurisdiction of the judicial branch family division in New Hampshire.

New Hampshire HB1206 amends RSA 490-D:3 to clarify that the judicial branch family division has the powers of a court of equity in cases where subject matter jurisdiction lies with the division and no other special provision has been made by law. This includes suits for divorce, nullity of marriage, alimony, custody of children, support, and similar proceedings. The bill specifies that these suits can be heard upon oral testimony or depositions, or both, or when both parties consent and appear. The act takes effect January 1, 2027.
