HB1195

Relative to municipal zoning requirements for child day care providers.

Chamber Passed·3/17/26

New Hampshire HB1195 modifies municipal zoning requirements for child day care providers.

New Hampshire HB1195 amends RSA 674:16, VI to allow municipalities to permit home-based care as an accessory use in residential zones. It also allows child care centers to operate by right on commercially zoned land, provided they meet RSA 170-E and related rules. The bill prohibits municipalities from enforcing ordinances that differ from RSA 170-E or related rules. It also allows existing buildings to be converted to child care centers without changing exterior dimensions. The changes take effect July 1, 2026.
