Nebraska LB993 creates a state-based civil remedy for individuals deprived of constitutional rights by law enforcement officers. It eliminates qualified immunity as a defense for such claims. The bill also waives sovereign immunity for these claims and exempts them from the Political Subdivisions Tort Claims Act and State Tort Claims Act. Public employers must indemnify officers unless they acted in bad faith or with malicious intent. The act becomes effective January 1, 2027.
