Nebraska LB482 modifies provisions for attorney's fees in insurance cases. It specifies that if a plaintiff fails to obtain a judgment for more than an offer made by the defendant, they will not recover the attorney's fee. However, this rule does not apply if the plaintiff's right to bring the action is based on a post-loss assignment of rights or benefits. The bill also repeals the original section 44-359, Reissue Revised Statutes of Nebraska, to harmonize the law.
