Montana SB49 would restrict judicial officers from initiating or conducting professional disciplinary proceedings or taking disciplinary measures against attorneys who serve as constitutional officers or legislators for actions taken during their term of office. The bill would bar such proceedings after the attorney leaves office if the basis for the proceeding arises while in office. However, a judge or justice of the peace may take disciplinary measures for courtroom behavior that disrupts a judicial proceeding.
