Montana SB431 revises residential covenant laws to protect property rights. It prevents homeowners' associations from enforcing covenants that impose more onerous restrictions on property use than those that existed when the owner acquired the property. The bill also limits enforcement of covenants for successors-in-interest unless they are family members or lenders. Existing covenants remain valid unless they are amended after the bill's effective date. The act does not invalidate existing covenants or create a private right of action for actions before May 9, 2019.
