Montana SB421 requires landlords to refund application fees if a tenant is not approved for a lease.

Montana SB421 mandates that landlords or managers refund application fees to applicants who do not secure a lease within 20 days. The landlord or manager must provide a written notice of the fee breakdown at the time of collection. If the applicant does not become a tenant, the landlord must refund the fee, minus any out-of-pocket costs not exceeding $25. The landlord or manager may also accept credit checks or criminal background checks from the applicant within the prior six months and waive the application fee.
