Montana SB381 makes certain state lands available for homesteading and sets requirements for qualified homesteaders.

Montana SB381 requires the Department of Natural Resources and Conservation to identify state-owned lands suitable for homesteading. These lands must be less than 100 contiguous acres, have legal access, be undeveloped, and not be designated as a state park or fishing access site. The department must sell homestead deeds to qualified homesteaders in parcels no larger than 5 acres. A qualified homesteader must be a continuous Montana resident for the past 10 years and must build a home with a permanent foundation within 5 years of acquiring the homestead deed.
