Montana SB293 allows claimants to request insurance information before filing a lawsuit.

Montana SB293 revises claimants' ability to receive insurance information before initiating litigation for personal injury or wrongful death. Claimants can request a statement of insurance limits from the insurer of a potentially responsible party. The insurer must respond within 45 days. If the insurer fails to respond, the claimant can petition the court for sanctions. The information requested is not admissible in evidence at trial and cannot be treated as part of an insurance agreement. The bill codifies these provisions and takes effect immediately upon passage.
