Montana SB21 allows legislative and executive leaders to vacate a writ of mandamus.
Montana SB21 amends the state's laws to allow the president of the senate or the speaker of the house of representatives, in conjunction with the governor or the attorney general, to vacate a writ of mandamus issued to compel an elected official or the legislature to produce documents or perform an action. The writ may be vacated within 10 business days of issuance by filing a joint pleading in the issuing court. Once vacated, the writ cannot be enforced, and the official cannot be found in contempt of court.
