Montana SB138 would revise education laws to affirm a teacher's authority to maintain a positive classroom learning environment. School district trustees must adopt a policy or include language in employee agreements defining this authority. Teachers can temporarily exclude pupils whose behavior impedes teaching or learning. A pupil may only return to class after a return plan is communicated to the teacher. The return plan may include a behavioral contract with the pupil. The bill applies to school years beginning on or after July 1, 2025.
