HB939

Montana HB939 revises wind turbine generator laws, setting minimum setbacks and deicing requirements.

Montana HB939 revises laws relating to wind turbine generators. It establishes a minimum setback of 1,500 feet from occupied residences for wind turbine towers 500 feet or taller. The bill also mandates a wind turbine generator deicing requirement, limiting the rotor blade speed to 90% of the maximum speed when within 2,500 feet of an occupied residence. The act amends wind energy agreements to include specific terms, such as property descriptions and compensation provisions, and requires these agreements to be notarized and filed with the Department of Environmental Quality.
