Montana HB923 revises categorical exclusions from a nondegradation authorization for areas where drinking water wells are prohibited and absorption trenches are at least 1,000 feet from downstream high-quality surface waters. The Department of Environmental Quality must amend ARM 17.30.716 by January 1, 2026, to reflect these changes. The bill also appropriates $10,000 from the general fund to the Department of Environmental Quality for the biennium beginning July 1, 2025, to amend the department's rules. The act is effective upon passage and approval, with Section 2 effective July 1, 2025.
