HB752

Montana HB752 prohibits content providers from allowing access to child sexual abuse material in Montana.

Montana HB752 prohibits content providers from making child sexual abuse material reasonably accessible in Montana. Content providers cannot profit from distributing such material. Victims can bring actions for violations, and the Department of Justice can also enforce the law. Remedies include injunctive relief, declaratory relief, compensatory damages, punitive damages, statutory damages, and attorney fees. A content provider has a defense if they remove the material within 48 hours of it being made accessible.
