Montana HB33 revises the law regarding petitions to initiate agency rulemaking. It allows an agency to summarily dismiss a petition if it raises an issue outside of the agency's regulatory jurisdiction or rulemaking authority. The agency is not required to advance such petitions to the rulemaking process. The bill amends Section 2-4-315, MCA, to include this provision and specifies that the act is effective upon passage and approval.
