SB1797

Missouri SB1797 establishes rules for severability of legislative acts, ensuring valid provisions remain in force if unconstitutional parts are.

Missouri SB1797 introduces provisions to ensure the severability of legislative acts. If a court finds a part of a legislative act unconstitutional, the remaining valid provisions will remain in effect unless the court determines the general assembly would not have enacted them without the unconstitutional part. This ensures that legislative intent is preserved as much as possible.
