Missouri SB1513 modifies provisions relating to fault determinations in tort actions. It bars plaintiffs from recovering damages if they are found to bear fifty-one percent or more of the fault. The bill also mandates that the trier of fact calculate damages based on the percentage of fault for each defendant. Assessments of fault for nonparties are used only in determining the fault of named parties, and findings of fact for nonparties cannot subject them to liability. The bill repeals and replaces section 537.067, RSMo, to reflect these changes.
