SB1391

Modifies requirements for appointing counsel for postconviction relief in death penalty cases in Missouri.

The bill modifies provisions for appointing counsel for postconviction relief in death penalty cases in Missouri. It requires that appointed counsel must have specific qualifications, including recent training, experience in criminal and postconviction law, and participation in certain types of trials. The court may reject the appointment of counsel if the defendant is not indigent. The state public defender must provide compensation and expenses for appointed counsel. The bill repeals and replaces existing law on this topic.
