Bentley and Mason's Law requires individuals convicted of driving while intoxicated, resulting in the death of a parent, to pay child maintenance to the surviving parent or guardian. Maintenance continues until the child dies, marries, enters military service, or reaches eighteen, unless they are enrolled in secondary or higher education. If enrolled in vocational or higher education, maintenance continues until the child completes their education or turns twenty-one. The court considers financial needs, resources, and other relevant factors when determining the amount of maintenance.
