This bill modifies provisions relating to products liability claims by abolishing contributory fault as a complete bar to plaintiff's recovery and applying the doctrine of pure comparative fault. It allows defendants to plead and prove the fault of the plaintiff as an affirmative defense. The bill also redefines "fault" to include actionable breaches of legal duty or omissions causing harm, including negligence, comparative negligence, assumption of risk, strict liability, breach of express or implied warranty, products liability, misuse, or modification or abuse of a product.
