Missouri HB2956 allows refiling of dismissed cases if dismissed before a preliminary hearing or by a prosecuting attorney.

Missouri HB2956 amends Chapter 544 of the Revised Statutes of Missouri by adding a new section, 544.255, which allows a case dismissed by the court before a preliminary hearing or by a prosecuting attorney to be refiled by the prosecuting attorney. However, if the case is dismissed a second time, the prosecuting attorney is prohibited from refiling it.
